Tampa sits in the Southwest Florida Water Management District, and that single fact governs more of a site plan here than most owners expect. The statewide permit rule is the same one that applies in Miami and in Pensacola. The design criteria a Tampa stormwater system has to meet are not. They come out of a district handbook that was replaced on October 31, 2025, and the version it replaced had stood since June 2018.

One Rule, and a Handbook Written for This District Alone
Florida runs one statewide environmental resource permit rule, Chapter 62-330 of the Florida Administrative Code, and it reaches every corner of the state. The design and performance criteria a stormwater system actually has to satisfy are not in that rule. They are in Volume II of the permit handbook, and each water management district adopts its own.
The Southwest Florida Water Management District says what its Volume II carries in plain terms: the district specific design and performance criteria for stormwater quantity, flood control, stormwater quality and any special basin criteria. It also says the document is intended for use only within the jurisdictional boundaries of the Southwest Florida Water Management District. Tampa is inside those boundaries. A design worked up against another district version is being measured with the wrong ruler.
The Date That Catches People Out
The district Volume II in force here took effect on October 31, 2025. The version before it had been effective since June 1, 2018. Volume I, the general and environmental volume that accompanies it, took effect on June 28, 2024.
That is more than a housekeeping detail. Seven years of Tampa projects were designed, permitted and built against the earlier volume, and a good deal of institutional habit was built with them. A calculation package assembled from an office template that predates the change is not automatically wrong, but nobody should assume it is right either.
A Second Rule Layer That Only Exists Here
Outside the statewide chapter, the district administers its own rule chapters in the Florida Administrative Code: 40D-4, 40D-40 and 40D-400. Those are district rules. They do not apply in the St. Johns River district or the South Florida district, which run their own numbered chapters.
So a Tampa project answers to the statewide chapter, to the district chapters underneath it, and to the district Volume II that fills in the numbers. Three documents, one submittal, and only the first of the three is the same as it would be anywhere else in Florida.
And the district boundary is not a county boundary. The Department of Environmental Protection lists the Southwest Florida district as covering Citrus, DeSoto, Hardee, Hernando, Hillsborough, Manatee, Pasco, Pinellas, Sarasota and Sumter counties, plus portions of Charlotte, Highlands, Lake, Levy, Marion and Polk. Six counties in that list are split. A parcel on the eastern edge of the Tampa market can sit in a different district from a parcel a few miles away, and the mailing address will not tell you which. That is a records question, answered before design rather than during review.
The City of Tampa Adds Requirements on Top of the District
Satisfying the district is necessary and it is not sufficient. Inside the city limits, the City of Tampa maintains its own Stormwater Technical Standards Manual, revised June 2022, and the standards published under it carry the force and effect of law.
The manual is explicit about how the two fit together. It states that all projects must still comply with pertinent Southwest Florida Water Management District stormwater rules. Then it adds a requirement of its own: private development will provide treatment in accordance with the district regulations, however a minimum water quality treatment will be required by the City of Tampa.
What That Means on a Real Site
- District treatment is the floor inside the city, not the ceiling. A design that clears the district can still be short of what the city requires.
- The city minimum has to be established at layout, because treatment area competes with parking, landscape and buffer for the same ground.
- Finding it at review usually means the site plan moves, and the site plan is the expensive drawing to move.
- Outside the city limits the code layer is the county rather than the city, which is a different document and a different reviewer.
Three Jurisdictions in One Metro Area
The Tampa market is not one regulatory environment. A project may sit inside the City of Tampa, in unincorporated Hillsborough County, or in one of the surrounding municipalities, and the local requirements change at each line while the district criteria stay the same.
Owners moving from one Tampa area project to the next are the group most often caught by this, because the last set of drawings got approved and the assumption is that the same approach will approve again.

Drainage, Flood Risk and the Tailwater Nobody Checked
Standing water in the same place after every storm looks like one problem and is usually one of four. They produce the same symptom and they do not share a repair, which is why the diagnosis is worth more than the fix.
The system is undersized for what is there now. Impervious area was added, a basin was filled, or the criteria have since been tightened. The system is doing what it was built to do and what it was built to do is no longer enough.
The system is the right size and has lost its capacity. A pond silted in, a control structure with a blocked orifice, an underdrain that has clogged, a swale regraded by twenty years of mowing. This is the cheapest of the four and the one most often skipped, because maintenance is the line item nobody wants to fund.
The outfall is the problem, not the site. In Tampa this deserves particular attention, because a large share of the county drains toward the bay and the tailwater at the outfall is not a constant. A system checked on a dry afternoon at low water can look entirely adequate and still back up in the condition that actually matters.
It is not stormwater at all. Seasonal high groundwater surfacing in a low spot, a leaking service line, irrigation overrun, or grading done on the parcel next door that changed where the water arrives from. These get treated as drainage failures regularly, and the repair costs a fraction of a new system.
When Basic Plans Are Not Enough
